Mag Defends Intellectual Property Rights
It is Mag's worldwide policy to act decisively against illicit product copying and other infringements of its intellectual property rights. Over the years Mag has achieved many multimillion-dollar court victories and large-scale customs seizures. In addition, Mag has settled hundreds of infringement claims out of court, generally with the infringer agreeing not only to desist but also to pay compensation. Here are some examples of Mag's recent activities in defense of its IP rights:
After winning a rare kind of flashlight design protection in Japan, Mag persuaded the Osaka District Court to prohibit Asahi Electric Corporation from making and selling "look-alikes" of the MINI MAGLITE® flashlight and to order Asahi's flashlight copies destroyed.
In Germany, in three recent customs proceedings, authorities seized and destroyed some 24,000 units of "look-alike" MAG-LITE®, MINI MAGLITE® and SOLITAIRE® flashlights, while in separate lawsuits several German courts issued injunctions and cease-and-desist orders against retailers of imitative products.
In late 2003, Libro Invest Aktienbolag, a Swedish importer and marketer of Taiwanese copies of the MINI MAGLITE® flashlight, was enjoined by the District Court of Stockholm from selling the copies, and was ordered to reimburse Mag Instrument for its litigation expenses, in addition to paying a statutory fine and damages. The defendant's remaining stock of infringing flashlights was destroyed.
In the United States, Mag has pending or under investigation dozens of claims for patent or trademark infringement, unfair competition or trade secret misappropriation. Within the past year or so, Mag has settled dozens of such claims, generally on terms requiring the infringer to desist, surrender any remaining inventory of infringing goods, and pay compensation. Mag also carefully monitors encroaching trademark applications and is very active in instituting trademark opposition proceedings when appropriate.
